By accessing or using the Hexated website (hexated.io) or any services provided by Hexated Ltd, you confirm that you are at least 18 years of age, have read and understood these Terms of Service, and agree to be bound by them. If you are using our services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

Hexated provides technology consulting, software development, quality assurance, and related professional services. The specific services, deliverables, timelines, and fees for any engagement are governed by a separate Statement of Work or Master Services Agreement executed between Hexated and the client. We reserve the right to modify, suspend, or discontinue any aspect of our website or general service offerings at any time without notice.

Unless otherwise agreed in writing: • Code, designs, documentation, and other deliverables created specifically for a client project and fully paid for become the property of the client upon final payment. • Pre-existing intellectual property, generic frameworks, tools, libraries, and methodologies remain the property of Hexated and are licensed (not transferred) to the client for use in the delivered project. • All content on our marketing website — including text, graphics, logos, and images — is the exclusive property of Hexated Ltd and may not be reproduced without express written permission.

You agree not to use our website or services to: • Violate any applicable law or regulation • Transmit any material that is unlawful, defamatory, harassing, or fraudulent • Attempt to gain unauthorised access to our systems or networks • Interfere with or disrupt the integrity or performance of our services • Scrape, copy, or harvest our website content by automated means • Use our services to develop a competing product or service without prior written consent

Both parties agree to keep confidential any non-public information disclosed during the course of an engagement and to use such information only for the purpose of performing obligations under the engagement. This obligation survives termination of any project for a period of three (3) years.

Our website and publicly accessible content are provided on an "as is" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by applicable law, Hexated shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses arising from your use of our website. In no event shall Hexated's aggregate liability for any claims relating to these Terms exceed the amount paid by you to Hexated in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Hexated, its directors, employees, and agents from any claims, damages, obligations, losses, or expenses arising from: (a) your use of and access to our website; (b) your violation of these Terms; or (c) your violation of any third-party right.

These Terms shall be governed by and construed in accordance with the laws applicable to Hexated's principal place of business at the time of engagement. Any dispute arising from or relating to these Terms will be addressed in good faith first, then through the competent courts agreed in the relevant client agreement where applicable.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting an updated version on this page with a new "Last updated" date. Your continued use of our website after such changes constitutes your acceptance of the revised Terms.
